About us
The Office of the Registrar-General was created in 2014 as part of the process of engaging a private-sector service provider to provide land registry and personal property registry services on behalf of the Province of Manitoba.
The Office of the Registrar-General includes the Registrar-General and support staff. The Office of the Registrar-General provides oversight of Manitoba’s service provider.
The Registrar-General
The Registrar-General is a lawyer and member of the Law Society of Manitoba appointed under The Public Service Act.
Applicable statutes
The Registrar-General exercises general oversight of the land registration and personal property registration systems and in accordance with the applicable legislation. This legislation includes:
- The Real Property Act;
- The Personal Property Security Act;
- The Registry Act; and
- The Condominium Act and Information.
Major Functions
The Registrar-General
- establishes Rules of Practice relating to the operation of the land and personal property registry systems and the governing of the provision of those services by the service provider
- publishes the Land Titles Guide for legal professionals and other members of the public
- designates statutory officials under the applicable legislation including district registrars, examiner of surveys and the registrar of personal property security
- makes rules for:
o Applications relating to a disputed interest in land, and
o mortgage and foreclosure proceedings. - approves the forms to be used in the land and personal property registration
The Registrar-General
- may hear applications under The Real Property Act with respect to matters described in section 169.2 and s. 169.4, which may include applications for claims for compensation
- provides opinions to statutory officials on a point of law or practice
- may refer matters to court for a determination and appear in court on appeals of the Registrar-General’s decision
- may order discharge of a mortgage under section 107 of The Real Property Act upon proof that all moneys due and owing have been paid
- exercises other powers and authorities given to the Registrar-General under applicable legislation
