Joseph Singer duly sworn deposed –

I am 19 years old and I live at Mr. Stewart’s house. After Hilda had gone away and Head had been sent after her after some time when he did not return Mr. Stewart went over to the Rex’s when he came back he told me to take the team and go and look for Head and Hilda for the Rex’s had told him they had seen Hilda go by Mr. Herbert Rex’s shanty about an hour before and they told him they put Head on their trail. So I had to take the team to give them a ride back, When I got near Rex’s I caught sight of a man on horseback coming towards the Rex’s and another man walking beside the horse at the same time I saw another man on horseback going from the Rex’s to meet them. When I came up with the horseman and the other man beside him I saw it was Mr. Carr with Hilda in front of him. And Head standing beside him, Head was wanting to take Hilda off the horse and Carr refused to let him have her. I asked him to give her up and he refused to let me have her. Just then Herbert Rex came up on horseback and threatened to run Head down if he didn’t get out of the way. We stayed there arguing for a few seconds and Carr and Herbert Rex rode off to the house with Hilda and immediately put her inside. When Mr. Rex and Miss Rex came outside the door and I went up and asked for the child again I asked all in turn (except Colin Rex) who were there to give up the child. Mrs. Rex said that if Mr. Stewart could bring papers to prove that he was the guardian she would give the child up and not until. Then we rode away home. I came over with Mr. [unknown] following words to trail objected to by Mr. Kennedy.
