Impacts of Regulated Vehicles Regulation as of January 1, 2025
Regulated vehicles, as defined in section 1(1) of the Highway Traffic Act (the Act), are busses, motor vehicles and trailers with a registered gross weight of 4,500 kg or more. Changes to the Act, and its regulations, came into force as of January 1, 2025. These changes affect only those regulated vehicle operators required to hold a Safety Fitness Certificate under section 312.1 of the Act.
The changes, which came into force on January 1, 2025, include:
- The consolidation of some regulated vehicle requirements into the Regulated Vehicles (Safety Fitness, Operator Identification and Records and Vehicle Exemptions) Regulation (the Regulation).
- Specific statutory power to refuse to issue a Safety Fitness Certificate to an operator who is deemed to be a safety risk, based on the operator’s safety record and/or the operator’s affiliation with another operator who has a poor safety record.
- Specific statutory power to assign a safety fitness rating to an operator based on the operator’s safety record and/or the operator’s affiliation with another operator who has a poor safety record.
- The requirement for all regulated vehicle operators to carry a copy of their Safety Fitness Certificate in the vehicle when operating in Manitoba.
- Manitoba Motor Carrier Enforcement will enforce this requirement on out-of-province regulated vehicle operators on Manitoba roads and highways.
- Manitoba recognizes all Canadian safety fitness certificates as equivalent to a Manitoba safety fitness certificate. For carriers based in provinces/territories that do not issue a safety fitness certificate, valid vehicle registration that includes a National Safety Code (NSC) number is acceptable.
The requirement for regulated vehicle markings to include the National Safety Code (NSC) number of the registered owner in clause 9(1)(b) of the Regulation.
