The Livestock Technical Review Committee (TRC) process ensures transparency and objectivity in the review of conditional use applications for large-scale livestock operations. The process:
·         Helps municipal councils make informed decisions about applications by providing objective technical reports.
·         Creates a common understanding about the potential impacts of proposed operations and any related regulatory requirements and safeguards.
·         Provides a forum where the public can share concerns and the applicant can respond.
 
Municipal conditional use approval is required for most new or expanding large-scale livestock operations of 300 or more animal units. Under The Planning Act, municipalities must refer these conditional use applications to the TRC.  The applicant must complete and submit a site assessment to the TRC. This process is explained in the Technical Review Committee Regulation. 
Quota increases and other proposals that involve changes to animal housing may be exempt. To determine if you qualify, refer to:

The TRC puts the completed site  assessment on the Public Registry before a 30-day public commenting period begins. During this time, provincial departments and the public review the site assessment. After the review is completed, Council holds a public hearing for the conditional use and makes a decision about the application (see TRC process).

The TRC comprises representatives from the departments of: Agriculture; Environment and Climate Change; Economic Development, Investment, Trade and Natural Resources; Transportation and Infrastructure; and Municipal and Northern Relations.

About the Livestock TRC review process
The TRC process requires proponents to prepare a site assessment, which is made available to the public. The public can then share informed comments about the proposal with the TRC, before the TRC prepares a report to the municipal council.
  • The applicant submits a site assessment along with their conditional use application to the municipality or planning district, which refers them to the TRC.
  • The TRC posts the site assessment on the TRC Public Registry.
  • The TRC notifies the public about the application through a notice placed in the local newspaper, which invites the public to provide comments. As a courtesy, the municipality or planning district is also requested to mail the notice to every landowner within 3 kilometres of the project site.
  • The public submits comments to the TRC during a 30-day commenting period. The TRC posts comments received on the Public Registry.
  • The TRC reviews the site assessment and public comments and writes a technical report on the application, which it sends to the municipality or planning district and posts on the Public Registry.
  • The municipality or planning district holds a public hearing for the conditional use application and makes a decision regarding the application, giving consideration to the TRC’s technical report.
  • The applicant may appeal a decision to reject their application or a condition imposed on approval to the Municipal Board within 14 days of the decision being made.
This process fulfills the TRC’s responsibility under The Planning Act [116(1)(b)(i))] to determine if a proposed operation can prevent or minimize risks to the health and safety of communities and the environment through appropriate practices and safeguards.
