Decisions

The decision of the Commission issues in the form of a document called a certificate which indicates the dollar amount which in the opinion of the Commission is the due compensation payable. Sometimes the certificate breaks down the decision of the Commission as between market value, special economic advantage, disturbance costs, damages for injurious affection, etc., although often the certificates will simply state that the dollar amount is for all compensable items. Regarding legal, appraisal, and other consulting costs, if any, reasonably incurred, the Commission initially does not fix these; it briefly makes reference to them in the certificate, leaving it up to the parties to try to agree on them; if the parties cannot agree on these items then either party can bring the matter back to the Commission.

By virtue of Rule 20 of the Commission will issue written reasons upon request. Actually, on its own initiative the Commission issues reasons in all cases.
